§ 1 Scope and Supplier
These general terms and conditions of business apply to all orders consumers (§ 13 BGB) place via the online shop from Radhika Malhotra, The State Divine, Boxhagener Strasse 111, 10245 Berlin (hereinafter called “The State Divine”). Consumer is any natural person who concludes a legal transaction with an intended purpose differently from his commercial or his self-consistent profession.

§ 2 Conclusion of the Contract
§ 2.1 The product presentation on the website has the purpose to place an offer to buy. By clicking "Confirm Order" your offer to buy is binding. Sale of our products is carried on basis of private use in small quantities only.
§ 2.2 We accept you order either by sending you an order confirmation by E-Mail or delivering you the goods within five days. Confirmation on receipt of order is based on automatic E-Mail reply and means acceptance of order.
§ 2.3 In case our order confirmation contains any writing or printing mistakes, or pricing should be wrongly indicated based on technical delivery faults, we are allowed to appeal, whereas we are in the position of proving the mistake. Payments made will be refunded immediately.

§ 3 Prices
The prices indicated on the product pages are including VAT and additional cost, but excluding shipping cost.

§ 4 Shipping Costs
For the delivery within Germany we charge the fixed amount of € 5.50 per order. As of an order value of € 65, inclusive value added tax, we dispatch within Germany your order free of delivery and transportation cost. Further taxes or costs do not arise.
For the delivery to the EU countries we charge a fixed amount of 15,50 € per order. Further taxes or costs do not arise. The EU countries are: Belgium (BE), Bulgaria (BG), Denmark (DK), Estonia (EE), Finland (FI), France (FR), Greece (GR), Great Britain (GB), Ireland (IE), Italy (IT), Latvia (LV), Lithuania (LT), Luxembourg (LU), Malta (MT), Netherlands (NL), Austria (AT), Poland (PL), Portugal (PT), Romania (RO), Sweden (SE), Slovakia (SK), Slovenia (SI), Spain (ES), Czech Republic (CZ), Hungary (HU), Cyprus (CY). For foreign addresses I kindly ask you to recheck at site if deliveries to PO Boxes are possible.
For deliveries to following countries we charge a fixed amount of 15,50 € per order: Faeroe Islands (FO), Monaco (MC), San Marino (SM). For deliveries abroad and countries which are not within the EU additional cost in regard to customs, fees and taxes will arise. For further information please consult with your local forwarder, customs and tax authorities. For foreign addresses I kindly ask you to recheck at site if deliveries to PO Boxes are possible.
For deliveries to following countries we charge a fixed amount of 25,50 € per order: Andorra (AD), Liechtenstein (LI), Norway (NO), Switzerland (CH), Vatican (VA). For deliveries abroad and countries which are not within the EU additional cost in regard to customs, fees and taxes will arise. For further information please consult with your local forwarder, customs and tax authorities. For foreign addresses I kindly ask you to recheck at site if deliveries to PO Boxes are possible.

§ 5 Delivery Terms
5.1 Within Germany the dispatch of your order is carried out by DHL. Deliveries to PO Box addresses are not possible.
5.2 The delivery time is 3-5 days, unless it indicated differently at the offer.
5.3. In case the ordered products are not in stock, we are entitles to split the delivery to partial deliveries on our own cost, as far as this is acceptable to you.
5.4 In case the delivery fails, even though the delivery service tried three times, we can withdraw from the contract. Payments made are immediately refunded to you.
5.5. In case the ordered product is not in stock, due to non delivery by our supplier, but without our fault, we are entitled to withdraw from the contract. In this case we will inform you immediately and if applicable suggest you an alternative product. In case no alternative product is available or you do not agree on the delivery of an alternative product, we will refund immediately, if necessary.

§ 6 Terms of Payment
6.1 Payment is made optionally by payment in advance, giropay or credit card.
6.2. While choosing the payment option payment in advance, we will inform you about our bank details within the order confirmation. Please transfer within 10 days the invoice amount to our bank account, while using your order number as reference. While paying via credit card, your credit card will be debited after shipping of the goods.

§ 7 Retention Title
The product remains our property until full payment. Before transition of ownership, pawning, transfer of ownership as security on a debt, processing or redesign without our consent in advance is not allowed.

§ 8 Right of Return
§ 8.1 In lieu of the right of withdrawal, consumers have a two-week unlimited right of return.

Return caution
Right of return

You have two weeks to cancel your order. You do not need to indicate why you are cancelling, but you do need to send your cancellation in writing (by letter, fax or e-mail). If you receive your order before the end of the two-week cancellation period, you can cancel it by returning it. The cancellation period begins when you receive this notice, but not before receipt of merchandise (if an order is split up into several deliveries, not before receipt of the first part of the order) and not before we have met our obligations to provide information according to Section 312c Subsection (2) of the BGB (German Civil Code) and Section 1 Subsections 1, 2 and 4 of the BGB-InfoV (Consumer Information Act) and our obligations according to Section 312e Subsection (1) Sentence 1 of the BGB and Section 3 of the BGB-InfoV. You have complied with the cancellation policy if you have sent your cancellation or returned your order before the end of the period specified. In every case the return is carried out at our expense and risk. I case of request of return the goods will be picked up at your address.

Consequences of Return
After an order has been cancelled, both parties must return any services received along with any capital gains taken (such as interest). If you are unable to return services you have received in whole or in part, or if you return them in poor condition, you may have to pay compensation. This does not apply if you return merchandise because you discover it is damaged when you check it upon receipt - checks that you could have conducted in the store were this not a non-store retailing operation. You can avoid paying compensation for merchandise you received by not making use of it and by keeping it out of harm‘s way. Responsibilities on refund of payments need to be fulfilled within 30 days. The period begins with the reshipment of goods or the request of return, for us with the receipt.

End of Instruction on Return

§ 8.2 The right of return does not exist for delivery of goods, which are made based on customers specifications or which clearly apply to customers’ needs. Furthermore the right of return does not exist for deliveries of audio or video recordings, neither software which have been unsealed by you.
§ 8.3 Please avoid damages and pollutions. If possible, please return the goods together with the original packaging as well as all accessories and packing components. Please ensure proper protection of the goods for reshipment. In case the original packaging does not exist anymore please use adequate packaging to avoid damages caused by transport and to avoid claims on compensation due to damages which arose from unsatisfactory packing.
§ 8.4 Please reship the goods as post-paid parcel and keep the mailing receipt. If you wish, we will compensate the postal charges in advance.
§ 8.5 Before sending back the goods, please call us on our telephone number +49 (0) 30 71 55 07 51 (0,14 EUR / min for calls from the German landline. Any calls and its related cost made from abroad are subject to the provider chosen) to inform us in advance about the reshipment. Like this we will be able to fast allocation of the goods.
§ 8.6 Please be aware that the modalities stated in § 8.3 to 8.5 are not preconditions to the effective exercise of your right of return.

§ 9 Damages in Transit
§ 9.1 In case packaging and/or products are delivered to you which are obviously damaged, please file immediately a complain at the forwarder directly and get in touch with us right afterwards. §9.2 Failure to file a complaint or to contact us does not have any influence on your legal warranty claim. However, you help us to be able to assert our own claims towards the forwarder, in fact transport insurance.

§ 10 Guarantee
The guarantee is based on the legal regulations.

§ 11 Liability
We exclude our liability for easily negligent breaches of duty provided that this not subject to essential obligations, damages from the injury of life, body or health or are subject to guarantees or claims in regard to the product liability act. the product liability law concern. Same applies to breaches of duty caused by our vicarious agents.

§ 12 Final Clause
If a regulation of these General terms and conditions of business should be ineffective, the remaining contract remains valid. In lieu of the ineffective regulation the appropriate legal provisions are valid.
